STALLION SERVICE AGREEMENT

I, _______________________________________________________, (owner as shown on mare’s Certificate of Registration) hereby agree to breed_________________________________

registration number ______________________________ age _____________ and color_______ to the stallion Macs Good N Plenty, Registration Number 3614932 and to pay the sum of $1250. The following are the terms and conditions of the agreement.

1. A non-refundable booking fee of $300 payable to Conifer Quarter Horses is due when this contract is signed and returned. This fee is applied to the total breeding fee but is not refundable except under Condition No. 11. The balance of the breeding fee, plus all veterinary charges will be due and payable when the mare is picked up.

2. A chute fee made payable to Conifer Quarter Horses in the amount of ________________________must be paid upon delivery of the mare to the breeding farm.

3. Breeder will exercise judgment in care and supervision of mare and/or foal. Breeder’s veterinarian will examine mare for normal breeding conditions and will administer medical care as deemed necessary for the health and safety of the mare and/or foal. All veterinarian and farrier expenses will be paid by mare owner.

4. I agree to accept full responsibility for any veterinarian expense incurred by my mare and foal. Such charges shall be paid whether or not the mare is settled. Veterinarian charges will be billed directly to mare owner. Expenses will be billed at the first of each month and are due upon receipt of statement.

5. All mares must have a negative coggins test within the last year and must be vaccinated against Equine Viral Abortion, Influenza and Strangles.

6. The breeder agrees to diligently try to settle the mare. If, however, she does not settle, the stallion owner nor the attending breed­er will be held responsible.

7. If for any reason the mare is unable to be settled in a reasonable period of time another mare may be substituted with the approval of the stallion owner.

8. I understand that the stallion owner, the attending veterinarian and/or their agents, employees and breeder will not be held responsible for accidents, sickness, or death to mare and/or foal.

9. I agree that a live foal is guaranteed for this mating. Should the foal not stand and nurse, the mare owner shall be entitled to return privileges. This will apply only if the stallion owner is notified within one week from the foaling date. This notice must be accom­panied by a veterinarian’s statement. Under the foregoing circumstances and upon receipt of the specified notice, it is agreed:

a. Stallion owner shall give to mare owner a return privilege to the stallion the following year only and to the same mare originally booked (unless otherwise mutually agreed in writing between mare owner and stallion owner).

b. If mare owner fails to deliver the mare (or a substitute mare if mutually agreed as stated above) for re-breeding the following year, then any and all fees paid shall be forfeited; the right to rebreed is thereby canceled and the stallion owner is released from any further obligation whatsoever.

c. If the mare dies or becomes unfit to breed then another mare may be substituted if approved by the stallion owner.

10. The owner of any mare who returns for a re-breeding must pay a chute fee of ___________ payable to Conifer Quarter Horses. The fee for veterinarian services must be paid in full when the mare is left for re-breeding (breeding).

11. It is further agreed that should the above stallion die or become unfit for service the breeding fee will be returned if requested by mare owner.

12. The Stallion Service Certificate will be issued only if the foal stands and nurses and same is reported to the stallion owner.

13. This contract represents the entire agreement between the parties. In the event the mare is sold or otherwise disposed of prior to the birth of the foal, the “Live Foal Guarantee” will no longer be valid.

14. This agreement is subject to the provisions of IC 32-8-29-1 (Liveryman’s Lien), to additionally include breeding fee.

15. If shipped semen is requested. A separate contract is required and where applicable is attached to and made a part of this agree­ment. If using shipped semen, return both contracts.

16. Mare Care Per Day: Dry $12.00 / Wet $14.00 / Blanketed $14.00
